TERMS OF SERVICE
Our Philosophy
- We work best with high-caliber brands, creators, and teams who value structure, clarity, and creative excellence. Our terms reflect the level of professionalism we bring, and expect in return.
1. Acceptance of Terms
- By using our services, you acknowledge and agree to these terms, which may be updated from time to time at APodcastGeek’s discretion. If you do not agree to these terms, you are not authorized to use our services.
2. Service Description
- APodcastGeek is a full- service podcasting agency specializing in podcast production/editing, management, marketing and strategy. Our services include, but are not limited to:
- Full podcast production (editing, mastering, and optimization)
- Custom intro/outro creation
- Video and audio enhancements
- Short-form social media clips
- Podcast launch strategy, management and consulting
- Show notes, YouTube descriptions, and marketing materials
- APodcastGeek reserves the right to modify, suspend, or discontinue any service at any time without prior notice.
3. Account Registration & Usage
- To access certain services, you will be required to create an account.
- You must provide accurate, complete, and up-to-date registration details.
- You are responsible for maintaining the confidentiality of your account information and for all activity that occurs under your account.
- APodcastGeek reserves the right to terminate or suspend accounts that violate these terms.
4. Payments & Subscriptions
- Full prepayment for any services are required.
- You agree to pay for the services you purchase, including applicable taxes (if required).
- Payments are non-refundable unless otherwise stated.
- If you have purchased a subscription-based service, it is your responsibility to monitor your account. APodcastGeek is not liable for missed cancellations, unattended subscriptions, or billing errors resulting from incorrect payment details.
- Prices are subject to change at APodcastGeek’s discretion.
- By purchasing a subscription, the client authorizes APodcastGeek to automatically charge the designated payment method on a recurring basis, according to the agreed billing schedule. The client agrees to maintain accurate, up-to-date billing information and ensure sufficient funds are available to fulfill payment obligations.
- In the event of a failed payment, APodcastGeek will automatically retry the charge once per day for three (3) consecutive days (the “Grace Period”). During the Grace Period, services will continue uninterrupted. If payment is not successfully collected by the end of the Grace Period, APodcastGeek reserves the right to suspend services until all outstanding payments are received or to end the agreement.
- The client acknowledges that continued failure to resolve payment issues within 3 consecutive days may result in termination of services and additional collection actions as permitted by law.
5. Service Delivery & Turnaround Times
- PAYG: Our standard turnaround time for ‘production-only’ services varies per order spec but is generally 10 business days.
- PAYG & Bulk Orders: If you submit more than one production at a time, your orders will be delivered consecutively (eg. You’ll receive the second production 10 business days after the first delivery).
- APG Podcast Accelerator: Our turnaround date is agreed during your onboarding.
- Delays caused by incomplete files, unclear instructions, or missing assets for submissions are not APodcastGeek’s responsibility and may affect your release/publishing date.
6. Usage Rights & Intellectual Property
- You own 100% of the podcast, including all audio, video, and creative assets produced by us. We may retain portfolio rights to showcase work, but all content belongs to you.
- The only assets owned by APodcastGeek are sessions (how we make your materials)
- APodcastGeek may feature completed work in its portfolio or marketing materials, but you have the right to decline.
- APodcastGeek holds masters for 7 days after delivery. We hold podcast sessions for 1 month after delivery. Any requests for masters after this period may be void.
7. Revision Policy
- Orders include one batch of revisions, limited to 10 preferential changes.
- If you exceed more than 1 round of revisions, multiple revisions and/or more than 10 actions are requested, a production fee of €40 applies. This will be sent to you via an invoice. Once paid, we will proceed with the additional requests.
- Revisions must be requested within 5 business days prior to the publishing of your episode. Requests made after this period may require a late revision fee of €40.
- Revisions go to the front of the queue once received and placed into ‘Working’ status and typically take 24-48hrs (business days).
- Highlight clips chosen by us cannot be replaced by alternative timecodes. If alternative timecodes are required, a new clip fee will be applicable.
8. Service Limitations & Fair Use
- Eachpackage covers one podcast show. If you operate multiple shows, you will need separate packages.
- APodcastGeek reserves the right to refuse service to clients who abuse or attempt to exploit our service model.
9. Refunds & Cancellations
- Refunds are not provided for services already rendered or in progress.
- Subscriptions cannot be paused but can be cancelled.
- Subscriptions can be canceled at any time after your 3rd month with us but we require 7 business days notice before the renewal date of your subscription. Payments made prior to cancellation are non-refundable.
- Bulk-Orders are non-refundable.
10. Liability & Indemnification
- APodcastGeek is not liable for any direct, indirect, incidental, or consequential damages resulting from the use of our services.
- By using our services, you agree to indemnify and hold harmless APodcastGeek and its affiliates from any claims, damages, or losses resulting from your use of our services.
11. Support & Communication
- To keep things efficient, all core communication happens through our client portal.
- Support is provided via email / our portal only. We strive to respond within 24-48 business hours.
- It is required that all communication be placed in the relevant thread / order page you’re referring to. You may need to log in to the portal to ensure this.
- Requests for custom edits, additional services, or consultationa must be made through support@apodcastgeek.com and may require additional fees.
- For strategic check-ins or urgent matters, calls are available by request but are limited to availability.
12. Third-Party Services & Software
- APodcastGeek may utilize third-party software (e.g., AI tools, stock footage, or royalty-free music) as part of our process.
- APodcastGeek is not responsible for third-party licensing issues arising from client misuse of provided materials.
13. Termination of Services
- To maintain quality standards, we reserve the right to discontinue service if client behavior includes any of the following:
- Scope related behaviour that interferes with our project flow or agreed strategy
- Excessive revision cycles beyond the agreed scope
- Ongoing lack of clarity or direction despite guidance
- Requests or demands outside of the original scope
- Abusive, disrespectful, or unethical conduct toward our team
- Repeated failure to resolve payment issues
- We’re proud to say the above almost never happens, because we’re selective about who we work with!
14. Updates to Terms
- APodcastGeek may update these Terms of Service at any time. Continued use of our services after any modifications constitutes your acceptance of the updated terms.
